Metro wins Name Dispute against Tesco

The British trading concern Tesco didn’t want to admit that Metro AG had protected its name as a European trademark. Therefore it submitted an objection but that has now been turned down by the European Court of the First Instance (T-191/04).

The dispute between the British supermarket chain, who run smaller supermarkets under the name ‘Tesco Metro’, and the German trading group had begun more than five years ago. In early 1998, Metro AG applied for its name as an EU trademark. At the end of 1999, the application was made public and in January 2000 the British concern lodged an objection. Its line of argument - it itself still owned rights to the name. The expiry date of the trademark ‘Metro’ protected by Tesco was July 2000.

The complaint from Tesco was rejected at first on the grounds that the concern had failed to show that their name rights had been extended by them by the required date . Later on, the EU Trademark Office found in favor of Tesco and explained that a proof of senior rights did not have to be produced at the time of the complaint and the submitted objection. Metro AG were therefore unable protect their name. As a result the German concern then called upon the European Court, which has now found in its favor. An appeal to the European Court against the decision is possible within two months.
