“MIU MIU” forces “MY MUI” to abandon their Business
Swiss Fashion Label has to endure Defeat

Two young businessmen from Switzerland found the fashion label “MY MUI”  and engage a dozen unemployed people. Then the upmarket label “MIU MIU” comes along and wants to forbid them from carrying on business. What sounds  like a David and Goliath situation is actually an example of a rather clumsy choice of  trademark and its consequences. MIU MIU, the Italian subsidiary  of Prada, declared the name  “MY MUI” as being capable of producing confusion and successfully prevented its registration. For the Swiss label, which despite being quite young was already  able to celebrate some success in Switzerland, this however means the end.

It was in 2004 that “MY MIU” was founded by Karli and Mathias Müller. They wanted to bring affordable fashion for young people on to the market, fashion which was to be made and marketed by the long-term unemployed and socially-disadvantaged. After they had applied for their label as a trademark, “MIU MIU” threatened with a civil case, just in case the name “MY MIU”  should indeed become registered by the Institute for Intellectual Property. Prada’s subsidiary  also raised an objection against trademark registration. At the end of October, the Institute for Intellectual Property did decline the registration because of too great a similarity

Patent lawyers for the “MY MUI” company have now recommended the company to produce no further clothes under this name and to forgo the label, according to a statement from “MY MUI”. One could certainly not have imagined such a decision as the name “MY MUI” differentiates very strongly from “MIU MIU” as much as the target groups contrast. “MY MUI” produced fashion for the smaller budget, while “MIU MIU” produce luxury articles.

The way forward is not yet clear to the young businessmen. It stands in the air as to whether the label should be re-named. A re-launching under a new name would be very costly.
