Trademark Protection for Highest Skyscraper in the World

Skyscrapers can not only be landmarks, they can also be trademarks as well. That has now been made clear by the owners of the 508 meter high, 101 storey ‘Taipei 101’ in Taiwan. They were no longer prepared to accept that every postcard and souvenir seller can profit from the greatest tourist attraction in the country without having to pay for the privilege.

The tower with the fastest lift in the world is in the ownership of the Taipei Financial Center Corp (TFCC), who have protected ‘Taipei 101’ as a three-dimensional trademark. The skyscraper is private property, stressed TFCC spokesperson Joery Wei in the Taipei Times. Therefore you are entitled to protect the trademark from misuse. In consideration of the sum which TFCC has already invested in the project, there could be, additionally, proceedings taken against traders for unfair competition and commercial misuse.

In the last year alone, TFCC have pinpointed 1000 companies who have used ‘Taipei 101’ for publicity purposes. The tourist attraction crops up on merchandising articles, in books, films and music videos. TFCC now wants to take the logical step and bring in license fees. These would apply to postcards as much as to TV commercials or films. Anyone profiting unlawfully from the trademark will have legal proceedings taken against them, according to Wei. For the Taiwanese Government however the use of the trademark should remain cost-free in future.

Jack Lu from the Taiwanese Patent and Trademark Office told the Taipei Times that so long as traders used the building as a background and not as a main attribute for their products, then according to Taiwanese law no infringement will be incurred. Whether this situation would be classed as unfair competition would have to be tested in individual cases.
